General
- Each unit owner shall keep his unit and its equipment, including decks, heating and air condition equipment, and all appliances and appurtenances in good order, condition and repair. In addition, each unit owner shall be responsible for all damage to any other units or to the common elements resulting from his/her failure or neglect to make any of the repairs required.
- No unit owner shall make any structural addition, alteration or improvement to a condo unit without the prior written consent of the Board of Directors. Approval/consent is done by submitting an ARB Architectural Review by Board Application.
- No unit owner shall paint or alter the exterior of his/her unit, including doors and windows, nor shall any unit owner paint or alter the exterior of any building, or alter any landscaping, shrub or plantings, without the prior written consent of the Board of Directors.
- No unit shall be used for other than residential purposes and the related common purposes for which the property was designed. Each unit and the common elements appertaining thereto, shall be occupied and used only by the unit owner, his or her family, guests or by authorized tenants and such tenants' family and guests.
- No unit may be used for the conduct of commercial activity.
- Nothing shall be renovated or kept in any unit or in the common elements which will increase the rate of insurance for the property without the prior written consent of the Board of Directors.
- No trash or garbage cans or containers of any sort may be placed outside of any unit. Trash is to be placed at the designated areas for collection only. The exception is the scheduled Tuesday morning pickup of trash and recycled items left at the front entry doors of residents/tenants.
- No immoral, improper, offensive or unlawful use shall be made of the property or any part thereof, and all valid laws, zoning ordinances and regulations of all governmental agencies having jurisdiction thereof shall be observed.
Balconies/Railings
- Ocean Shore Condominium Association Bylaws prohibit items being hung over balcony railings. Specifically stated "hanging of garments, towels, blankets, rugs, and the like from the decks, porches, balconies or windows or from any of the facades of the property is prohibited." The hanging of potted plants or any other item such as wind chimes from the ceilings and walls of your balcony is not permitted since strong winds may cause damage to a neighbor's windows and/or vehicles parked below.
- The installation of ceiling fans on balconies is prohibited since strong winds may cause damage to a neighbor's windows and/or vehicles parked below.
- The Board prohibits cleaning of patio balconies by power washing. It is too disruptive to other residents and may cause damage to the balconies.
- All balcony railings and trim is defined in the Association's Declaration as a limited common element. Therefore, any repair or painting of railings will be coordinated by the Association, and the cost of such repairs or maintenance shall be specially assessed to the unit or units to which they appertain.
Flags
Residents are allowed to hang only the American Flag from their balconies. The flag cannot be any larger than 3 feet by 5 feet.
Gas Grills
Gas propane grills are permitted on patio balconies. Residents should have a fire extinguisher stored nearby in their respective patio closet in case of a fire incident.
Guests
Day guests are those visitors/guests staying for just the day. Resident house guests are those visitors/guests who will be remaining in your unit, with or without you being there, for several days or an extended period of time. Unit owners assume full responsibility for the conduct of their guests and shall be responsible for adhering to all rules and regulations..
HVAC Heat/Air Condition Units
Setting Thermostat No Lower Than 65 Degrees - November 1 through April 1
Owners that will not occupy their units for 21 consecutive days or more must notify United Property Associates of their plan to be away for an extended period of time (particularly those owners of second homes located out of the area). It is critical that owners set their thermostat no lower than 65 degrees during the winter months - November 1 through April 1 - to prevent the freezing of pipes in their unit. In addition, the owners must provide UPA with a "point of contact" that has a key and can provide access to the unit in case of an emergency. Owners are responsible to relay this important information to renters as well.
Maintenance of HVAC Units Inside Your Condo
Residents/tenants are encouraged to pour a cup of distilled white vinegar down their AC condensate line in the mechanical room each month during spring/summer/fall to help keep mold and sediment from clogging the line. Another option is to use a drain defense solution to keep pipes clear. Please do not use bleach - it is corrosive and may damage your equipment. This task needs to be performed monthly - especially during our hot and humid season when the unis are working hard. If you do not perform this basic maintenance regularly, mold and sediment will build up in side your drain line and not allow it to properly drain. For an easy reminder, plan on performing this necessary maintenance the 1st day of each month - add it to your electronic calendar. If your condensate drain becomes blocked, water will back up into your condo causing damage to your baseboards, floor and sub-floor. Then the water will migrate to your neighbors' units adjacent and below you causing ceiling and floor damage. This preventive measure will save potentially thousands of dollars of damage not to mention the inconvenience the flood will cause you and your neighbors. Keys
Consider giving a neighbor a key to your unit so, in case of an emergency, this provides a better chance that a neighbor and/or Board member can gain access if a resident cannot be reached in a timely manner.
Noise Restrictions
Residents and guests shall exercise extreme care in making noises or using musical instruments, radios, televisions, amplifiers or other noise producing instruments that may disturb other residents. No such device shall be operated outside of a unit or on any general common area including balconies, pool deck area or the parking area. While not specifically addressed in the Bylaws, the Board considers wind chimes to be included in the list of musical items.
Roofs and Attics
No unit owner is permitted on the roof of their building or in the attics. Only professional contractors are allowed on the roof and in attics for emergency repairs and maintenance. Work on the roofs and the attics of buildings is not authorized unless approved by the Board of Directors. All unit owners must submit an ARB Architectural Review by Board Application for approval.

Smoke Alarms
Virginia state law requires the installation of smoke alarms in all units. Residents/tenants should check their smoke alarms on a regular basis - including the installation of new batteries.
Smoking
Smoking is only allowed inside individual owners' units and patio balconies. Smoking is NOT allowed in the common elements of the Ocean Shore community including elevators, stairwells and elevator breezeways. Smoking is NOT allowed anywhere on the common grounds of Ocean Shore property. In addition, contractors are NOT allowed to smoke on Ocean Shore property. Residents are responsible for ensuring that their respective contractors DO NOT SMOKE ON OCEAN SHORE PROPERTY.
Water Leaks
Water leaks must be addressed immediately when discovered. They rarely resolve themselves and normally get worse over time. In addition to causing damage to your unit, water leaks may also damage your neighbor's unit or a common area of the property. It is highly recommended that residents purchase water detectors/alarms for their units. These inexpensive items will let you know if there is a problem in places like the washing machine, water heater or a bathroom that is not frequently used. An ounce of prevention may preclude major problems for you and your neighbors.

All draperies, binds, curtains or other window treatments visible from the exterior of each unit shall be white or off white in color.
